He resigned as deputy prime minister and local development minister in early November 2007 when this corruption case was reopened. At the same time he was under pressure from his own party and the centre-right coalition government over media information that his family was taking social benefits in the early 1990s when it had 3.5 million crowns on accounts. In the second half of last November the Supreme State Attorney's Office upheld the definitive halting of Cunek's criminal prosecution.
