07.05.2008 - Bundeswehr deployment unconstitutional

Germany's highest court says the deployment of German reconnaisance aircraft during the Iraq war in 2003 violated the country's constitution because the mission was not approved by parliament. The court ruled the deployment of German crews to man NATO AWAC planes patrolling Turkish airspace to provide early warning of attack by missiles or hostile aircraft should have had prior approval by the Bundestag, the lower house of parliament.

The Bundeswehr soldiers also monitored Iraqi airspace and passed information to NATO combat aircraft. Germany's Social Democrat-led government at the time said the mission was purely defensive and therefore did not need to be passed in the Bundestag.
