Actress Halle Berry has accused a paparazzi photographer of trespassing onto her property to get shots of her with her four-month-old daughter.
The pictures, which appear in two celebrity magazines, were supposedly taken "out and about in Los Angeles".
But the Oscar-winner says she was in her private back garden, and has complained to police.
The agency which distributed the images, Fame Pictures, has not commented on Berry's claims.
In Touch Weekly and Life & Style Weekly, which both used the photographs, said they used them in good faith.
"In Touch Weekly and Life & Style Weekly licensed the photograph of Halle Berry and her baby from an established photo agency. The magazines are not aware that there was anything improper in the taking of this image," a spokesperson for Bauer Publications told the Associated Press.
The photographs also appear on a number of websites.
'Public figure'
Berry's lawyer, Evan Spiegel, said witnesses saw the photographer commit a "very blatant and invasive trespass" to obtain the pictures of the actress with baby Nahla Ariela Aubry.
Trespassing is illegal under California law.
Berry, 41, said in a statement to AP: "I have long since come to terms with the fact that choosing a career as an actress has made me a public figure, but my baby has made no such choice, and unless and until she does, I will do everything I can... to keep her out of the public eye."
The photos, some of which have blurred leaves in the foreground, show Berry holding her daughter.
Berry's mother also appears in some of the photos. Nahla's father, Gabriel Aubry, is not seen in the images.
The incident comes days before a regional task force is due to meet in Los Angeles to discuss the activities of the paparazzi, following a number of incidents in and around the city.
Last month police had to break up confrontations on Malibu beach between locals and photographers hoping to capture actor Matthew McConaughey surfing.
And on Monday, two photographers were arrested near Britney Spears' home because they refused to leave a fire access road with views over the singer's gated community.
